Terms of Service — Pokebundles Ireland

These Terms of Service ("Terms") govern your access to and use of https://www.pokebundles.ie (the "Site") and any purchases or services provided by For The Fans Limited, trading as Pokebundles Ireland ("we", "us", or "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

Nothing in these Terms affects your statutory rights as a consumer under Irish and EU law. Where these Terms conflict with those rights, your statutory rights prevail.

1. Eligibility and acceptable use

• You must be at least 18, or the age of majority in your jurisdiction, to use the Site.
• You may not use the Site or our products for any unlawful or unauthorised purpose.
• We may suspend or terminate your access if you breach these Terms.

2. Our online store

• Our store is hosted on Shopify Inc., which provides the underlying e-commerce platform.
• When you place an order you agree to provide accurate and complete billing, shipping, and contact details.
• We may refuse or cancel any order, or limit quantities, at our reasonable discretion — for example where an item is mispriced, out of stock, or we suspect fraud.

3. Orders and contract formation

• Your order is an offer to buy. A binding contract is formed only when we send you a dispatch confirmation for the relevant item(s) — not when you place the order or receive an order acknowledgement.
• If we cannot fulfil an order, we will let you know and refund any payment taken for the affected items.

4. Products and pricing

• Prices, product descriptions, and availability may change at any time without notice.
• We take care to price and describe products accurately, but errors can occur. Where an item's correct price is clearly different from the price listed, we may cancel the order and refund you, even after a dispatch confirmation.
• We may discontinue any product or limit quantities.

5. Shipping

• Orders ship once all items are available. If your order includes pre-order or out-of-stock items, we hold it until everything is ready — contact us if you would prefer to split the order.
• Delivery timescales are estimates. Once an order has been dispatched, delays in the carrier's network are outside our control, though we will help you follow up where we can.
• Risk in the goods passes to you on delivery.

6. Returns and refunds

• If you are a consumer buying online, you generally have a statutory right to cancel most orders within 14 days of receiving them, for any reason, under EU/Irish distance-selling rules. Full details are in our Refund Policy.
• Returned items should be in their original condition. Some items may be exempt from the cooling-off right where the law allows.
• Sealed trading card products — such as individual booster packs, bundles, and sealed boxes — are non-returnable and non-refundable, whether opened or unopened. Because sealed packs can be weighed or otherwise assessed to identify high-value packs before being returned, we cannot accept returns of these items once they have left us. This does not affect your rights in respect of items that are faulty or not as described.
• Except where an item is faulty, incorrectly supplied, or where the law provides otherwise, you are responsible for return postage.
• This section does not limit your statutory rights in relation to faulty or misdescribed goods.

7. Single trading card sales

We want you to know exactly what to expect when you buy single trading cards from us.

• Condition. All single cards are in at least Near Mint (NM) condition — nearly perfect, with only very minor wear visible on close inspection. Some may arrive Mint, but we advertise everything as Near Mint so we consistently meet or exceed your expectations.
• Gradability. We do not guarantee that any card is gradable or will achieve a particular grade from a third-party grading service. Factory and printing imperfections — off-centre cuts, print lines, roller marks, snow, or colour variation — come straight from the pack and are outside our control. A card can be genuinely Near Mint and still grade poorly, or be deemed ungradable, for these reasons.
• Stock images. Listing images are stock images representing the card's artwork, not photographs of the exact card you will receive. You will always get the card named in the listing title, but its centering, edges, corners, and surface may differ from the image.
• Packaging. Every card is sent in an Ultra Pro sleeve, and higher-value cards additionally receive a toploader. All orders are packaged securely for transit.
• Problems. If a card does not meet the advertised condition, contact us within 30 days at support@pokebundles.ie or via our contact form and we will put it right.

8. Card buying policy (selling cards to us)

• Cards you submit for sale must match the condition you described.
• If cards arrive in a lesser condition than described, we may revise our offer.
• If you do not accept a revised offer, we will return the cards to you at your expense.
• By sending cards, you confirm you are their legal owner and accept our final offer unless you request their return.

9. Personal information

• Your submission of personal information is governed by our Privacy Policy.
• We process personal data in line with the GDPR and applicable Irish data protection law.
• We share your data only with the service providers needed to run our business and fulfil your order (for example Shopify and our fulfilment partner).

10. Third-party services

• The Site may link to or use tools and services provided by third parties, which you use at your own risk.
• We are not responsible for the content, tools, or services of third parties, or for their terms and privacy practices.

11. Intellectual property

• The Site and its content are owned by us or our licensors. You may not reproduce, copy, sell, or otherwise exploit any part of the Site or our services without our written permission.
• All trademarks, logos, character names, and product names are the property of their respective owners. We are an independent retailer and are not affiliated with, endorsed by, or sponsored by any trading card publisher or brand whose products we resell.

12. Prohibited uses

You may not use the Site or its content:

• for any unlawful purpose, or to breach any applicable law or regulation;
• to infringe our or anyone else's intellectual property rights;
• to harass, abuse, defame, or discriminate against any person;
• to upload or transmit malicious code, or to interfere with the security or operation of the Site; or
• to collect or track others' personal data without consent, or to send unsolicited advertising.

We may terminate your use of the Site for breaching this section.

13. Limitation of liability

• We provide the Site on a reasonable-efforts basis and do not guarantee it will be uninterrupted or error-free.
• Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for your mandatory statutory rights as a consumer.
• Subject to the above, we are not liable for indirect or unforeseeable losses, and our total liability arising from your use of the Site or a purchase is limited to the amount you paid for the relevant order.

14. Indemnification

You agree to indemnify and hold harmless For The Fans Limited and its affiliates from any claims, losses, or costs arising from your breach of these Terms or your violation of any law or third-party rights. This does not apply to the extent a loss results from our own breach or negligence.

15. Termination

• You may stop using the Site at any time.
• We may suspend or terminate your access if you breach these Terms. Termination does not affect any rights or obligations that accrued beforehand.

16. General

• Governing law. These Terms are governed by the laws of Ireland, and the Irish courts have jurisdiction. If you are a consumer, you keep the benefit of any mandatory protections of the country where you live.
• Severability. If any provision is found unenforceable, the remaining provisions stay in force.
• Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, form the entire agreement between us.
• Changes. We may update these Terms at any time. The current version will always be posted on this page with its effective date, and continued use of the Site means you accept the updated Terms.
